The Petition under Section 439(2) of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'CrPC') read with Section 482 of CrPC, has been filed on behalf of the Petitioner/State, for the cancellation of Anticipatory Bail granted to the Respondent, namely, Chanakya Mann @Sanju vide Order dated 09.04.2021, passed by learned ASJ, Rohini Courts, Delhi in FIR No. 67/2021 under Section 307/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC'), registered at Police Station Alipur, Delhi in case title State vs Chanakya Mann @ Sanju & Anr. 2.
Learned counsel on behalf of the Respondent has submitted that the similar Application for cancellation of Bail, was filed by the father of the victim, which has been dismissed by a detailed Order of this Court in CRL.M.C. 1277/2021 vide Order dated 14.07.2021. It is, therefore, submitted that in view of the detailed observations made by this Court in the said Order, nothing survives in the present Petition. 3.
Learned APP for the State, after going through the Order, submits that in view of the Order dated 14.07.2021, the present Petition has become infructuous. 4.
The Petition is disposed of accordingly.
