Present public interest petition has been filed seeking issuance of directions to initiate a court monitored survey to identify the illegal construction and business activities being carried out at CC Block, Shalimar Bagh, New Delhi-110088.

The petitioner-in-person states that one Mr. Gulati has illegally constructed extra floors and is also running a tuition centre at 75-D/CC Block, Shalimar Bagh, New Delhi-110088. The petitioner states that she submitted various complaints with the respondent upto 30th November, 2023, however no action has been taken till date. 3.

She states that in a noting on a letter dated 24th August, 2022 issued by the NDMC, it has been stated that demolition action has been taken with respect to the aforesaid property with the help of PS Shalimar Bagh on 29th The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. August, 2022, whereas, in fact no demolition has been carried out till date. 4.

Upon a perusal of the present petition, this Court finds that the petitioner has not impleaded the owners/occupants of any of the properties against whom she wants demolition action to be taken. 5.

Consequently, the present writ petition along with the application is dismissed with liberty to the petitioner to file a fresh petition after giving adequate notice to the respondent-MCD clearly mentioning the properties in which unauthorised and illegal construction has been carried out and after impleading all such owners/occupants.
