O R D E R

% 01.11.2019 Mr. Puri as well as the learned counsel for the respondents state that the respondent No.2, whose appointment as a nominee Arbitrator for NHAI has been challenged in this petition, has since resigned. He states that a new Arbitrator namely Sh. Chaman Lal has been nominated by NHAI. He further states that he has objection with regard to appointment of Sh. Chaman Lal under Section 12 of the Arbitration & Conciliation Act, 1996. The Court say nothing, insofar as the appointment of Sh. Chaman Lal is concerned as, his appointment is not the subject-matter of the petition. The petitioner, if so advised, can seek such remedy as available in law. The petition is dismissed as infructuous.
