Concededly, the charges have already been framed in the present case by order dated 05.07.2024.

The present petition was filed way back in the year 2019 seeking quashing of FIR No.43/2019, dated 03.03.2019, registered at police station Shakarpur, for offences under Sections 376/506 of the Indian Penal Code, 1860. 3.
The petition has been pending and is getting adjourned for some reason or the other. From March, 2020 till April, 2022, the matter could not be heard due to enbloc adjournments of cases due to onset of COVID-19. The matter was, thereafter, listed in December, 2022, and the learned counsel for the petitioner sought time to address arguments. The matter, thereafter, has not been heard for some reason or the other. adjournment was sought on behalf of the petitioner and on some dates, the respondent had taken time. Much water has flown since the filing of the present petition and the charges have already been framed.

This Court, at this stage when the chargesheet has been filed and the charges have also been framed, does not consider it apposite to consider the prayer for quashing of the FIR. 5.
Even otherwise, the petitioner is at liberty to challenge the order framing charges.

The present petition is therefore dismissed with liberty to the petitioner to file an appropriate petition, if advised, challenging the order on charge dated 05.07.2024. AMIT MAHAJAN, J OCTOBER 1, 2024 'Aman'
