A status report has been filed in W.P(CRL) 2579/2019 captioned
'Capital Land Builders Pvt Ltd vs Govt. of NCT of Delhi & Ors.', which indicates that, prima facie, there was some laxity on the part of the investigating officer (IO) and he has, therefore, been removed from the case. It is stated that Insp. Abhishek Kumar has been appointed as the IO. Although he has collected all relevant documents, nonetheless, it is stated that he also requires to arrest the accused Pushpender and Mrs. Darshi for recovery of the alleged sale deeds/GPAs. The said accused have not been arrested as they are absconding. It is stated that a raid had been conducted at their premises on 13.01.2020, but they could not be traced. 5.
Mr Mahajan, learned ASC states that in the event they are not traced, necessary proceedings under Sections 82/83 of the Cr.P.C. for declaring them as proclaimed offenders are required to be undertaken. He states, on instructions, that the investigation would require a further period of four months.
6.
In view of the above, the present petition is disposed of by directing the respondent to conclude the investigation as expeditiously as possible and in any event, within a period of four months, as indicated above. 7.
The petition is disposed of with the aforesaid directions. VIBHU BAKHRU, J JANUARY 27, 2020 pkv
