The petitioner in the instant writ petition seeks for directions to respondent No.1 to take immediate steps to stop alleged ongoing illegal/unauthorised construction being carried out by respondent No.3 over the property in question i.e., P-102-A, Khasra No.213, Nafees Road, Batla House, Jamia Nagar, Okhla, New Delhi. direction to demolish the alleged unauthorised structure which has been allegedly constructed illegally over the property in question. 2.

Having perused the material placed on record, it is evidently seen that the petitioner has already filed a civil suit before the Court of Civil Judge02/SED, Saket Courts, New Delhi. The order sheets placed on record dated 06.03.2024 and 02.05.2024 would also indicate that the concerned Court is already seized with the aforesaid civil suit. 3.

It is further observed that the petitioner, on both the dates, has not pressed for any ex-parte interim injunction.

In view of the aforesaid, this Court is not inclined to entertain the instant writ petition and leaves it open to the petitioner to take appropriate remedy or to pursue the remedy which has already been resorted to. 5.
