The present petition has been initiated on behalf of the National Federation of Fisherman Cooperative Ltd. (FISHCOPFED) purportedly through its Managing Director, Mr. Rishikesh Kashyap. 2.
During the course of hearing, it is noticed that in the context of W.P.(C) 5700/2024 filed by the same society through Mr. Rishikesh Kashyap, the order dated 07.05.2024 reads as under:- "4. In our considered opinion, in view of the aforesaid factual scenario where the persons in-charge of the affairs of the Society are members represented by the review Applicant, who were elected on 25th February, 2021 and there is no legal recognition of Sh. Rishikesh Kashyap as the Managing Director of the Society, the writ petition could not have been maintained by Sh. Rishikesh Kashyap in the name of the Society, i.e., FISHCOPFED. Thus, since the order dated 24th April, 2024 was passed on the premise that the present petition has been filed by the Society, the said assumption having been proved to be incorrect, the said order is hereby recalled and the present writ petition is dismissed.

party including Mr. Rishikesh Kashyap to avail its remedy of arbitration in his/her independent capacity before the appropriate forum in accordance with the liberty reserved by the Court vide order dated 05th March, 2024 in OMP No. 1/2021."

Admittedly, the said order dated 07.05.2024 passed by the Division Bench of this Court in W.P.(C) 5700/2024 has neither been interfered with nor interdicted in any subsequent legal proceedings. In the circumstances, it is evident that Mr. Rishikesh Kashyap has no locus to file the present petition on behalf of the concerned society.

Needless to say, Mr. Rishikesh Kashyap shall be at liberty to avail legal remedies in his individual capacity as directed by the Division Bench of this Court vide Paragraph 5 of the order dated 07.05.2024. 5.
Further, in case any subsequent directions have been issued for appointment of an Administrator (as contended by the petitioner), it shall be for the Administrator to take appropriate legal recourse on behalf of the society.

The present petition stands disposed of in the above terms. Pending application also stands disposed of.
