This hearing has been done through hybrid mode. CM APPL. 78802/2025 (under section 151 of the CPC seeking directions) 2.

The present application under Section 151 of the CPC seeks the following prayers:

<a) Allow the present application and direct the Respondent to Comply with the undertaking given by him as recorded in the ordered 16.07.2025;

b) Pass such other and further order or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case and in the interest of justice and equity.= 3.

Vide order dated 16.07.2025, the following directions were passed: <1. Learned counsel for the petitioner states that in view of the withdrawal of the review petition in W.P.(C) 13659/2021, the follow-up steps would be taken within a period of four weeks. <2. Learned counsel appearing for the respondent states, upon instructions, that the statement made on 07.10.2022 in W.P.(C) The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. No.13659/2021 would be complied with within four weeks as a follow-up step, and the challan would be issued to the petitioner. Learned counsel for the petitioner submits that on receipt of the challan, the requisite payment would be made within two weeks thereafter. The statement made today is accepted and is taken on record.

In view of the aforesaid, the contempt petition is also disposed of, along with the pending application.= 4.

Learned counsel for the petitioner/applicant submits that despite the several attempts, the respondent has not complied with the undertaking given in the aforesaid order.

Learned counsel for the respondent, on advance notice, submits that the petitioner may appear before the Deputy Chief Material Manager on 06.01.2026 at 04:00 PM along with the relevant documents and necessary steps in compliance of the aforesaid will be taken. 6.

The statement is taken on record.

In view of the above, the present application is disposed of with liberty to the applicant/petitioner to revive the petition in case of further noncompliance.
