Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner, Sandeep for quashing of the FIR No. 153/2025 under Section 289/125 of the Bharaiya Nyaya Sanhita, 2023, registered at Police Station Mundka, District West, in view of the Settlement dated 29.03.2025.

On advance Notice, learned ASC for the State appears and accepts Notice.

The brief facts are that the Petitioner, who was the godown owner, had engaged Mr. Manoj Kumar, for installation of the lift in his godown while doing so, he slipped and fell from a height and suffered injuries, to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

which he ultimately succumbed after three days. The Petitioner, as well as, the Respondent Nos.2 to 4, had old friendly relations. The Petitioner had taken the deceased to the hospital and had provided all the monetary and other support. Though, unfortunately, he died. It has also been noted that though, there is no criminality or negligence that can be annexed to the Petitioner but considering their friendly relationship, they have agreed to settle the matter.

It is stated that the Petitioner and the legal heirs of Mr. Manoj Kumar, have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 29.03.2025. In the Settlement, it was inter alia settled between the parties that the Petitioner shall pay a sum of 1,00,000/- towards full and final settlement of all the claims. The Petitioner has paid Rs.70,000/- in the Court today while the balance amount of Rs.30,000/- already stands paid. 5.

The Respondent No.2, 3 and 4 are present in person in the Court and states that they have received all amounts due to them and have no objection if the said FIR is quashed.

The Statement of the parties have already been recorded before the learned Joint Registrar. They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 153/2025 under Section 289/125 of the Bharaiya Nyaya Sanhita, 2023, registered at Police Station Mundka, District West and all the consequential proceedings emanating therefrom are quashed. The Petition is disposed of accordingly.
