Through the instant writ petition, filed under Article 226 of the Constitution of India, the Petitioner seeks release of the seized moveable property of the Petitioner i.e., one vehicle, which is currently seized in an action initiated under Section 17 of Prevention of Money Laundering Act, 20021, in ECIR/GNZO/11/2024.

Mr. Prabhas Bajaj, counsel for Petitioner, submits that the Petitioner is willing to offer the value of the seized articles in cash/ Fixed Deposit Receipts, as substitution for the seized vehicle. 1 "PMLA Act"

Mr. Shoumendu Mukherji, SPP for ED, without prejudice to the rights and contentions of ED, submits that since the seized vehicle - i.e., the Car bearing no. DL 9C BD 6336, car model - Mercedes Benz GLS 400D 4MATIC, whose registered owner is M/s Alstone Manufacturing Pvt. Ltd. - is depreciable in nature, the same can be released on superdari, subject to payment of an amount equivalent to the value of the seized property as denoted in the Insurance Certificate or as per present value of the property, whichever is higher. He further submits that the value of such property may be deposited with the Enforcement Directorate. 5.

In light of the above, the present petition is disposed of with a direction that the seized vehicle, details whereof are mentioned in paragraph No. 9 of the petition, be released on superdari to the Petitioner, subject to deposit of the monetary value of the said vehicle, as mentioned in the latest Insurance Certificate. The deposit be made in the name of "Joint Director, Gurugam Zonal Office" (A/c No. 924020049920405. Axis Bank, MG Road, Gurugram) by way of a Demand Draft/Pay Order. 6.

It is made clear that the Court has not commented on the merits of the present case. All rights and contentions of the parties are left open. 7.

Disposed of.
