O R D E R

The present petition is filed seeking release of the petitioner on parole for a period of three months in FIR No. 95/2010, registered at Police Station Chandi Mahal. 2.

The petitioner essentially seeks parole on the ground that urgent repairs are required in the house where his family resides. 3.

The status report has been filed by the State. It is mentioned that on verification, it was found that the petitioner's wife and child stay in the concerned house along with the petitioner's brother and his family. The statement of the brother was recorded and he stated that he was not planning to carry out any repairs of the house at the moment.

It is pointed out that the petitioner was absconding during the course of trial and was declared as a Proclaimed Offender as well, though he surrendered subsequently.

The petitioner was thereafter admitted on bail by order dated 16.03.2017, however, after dismissal of his appeal on 25.11.2017, he failed to surrender and again absconded for a period of seven years. The petitioner was only rearrested on 16.03.2024.

The learned counsel for the petitioner stresses that the conduct of the petitioner pursuant to his arrest has been satisfactory.

Not much time has elapsed after the arrest of the petitioner after his absconsion for a period of seven years. The chances of the petitioner absconding again on his release are high. In the opinion of this Court, the conduct of the petitioner does not entitle him to the benefit of parole.

The petition is, therefore, dismissed.
