The above-captioned application has been filed jointly by the parties. 2.

Via the instant application, the leave of the Court is sought to withdraw the appeal.

A perusal of the application shows that the parties have entered into a settlement, albeit under the aegis of the Delhi High Court Mediation and Conciliation Centre.

The application is accompanied by a Settlement Agreement dated 13.06.2024 [in short, "SA"].

4.1 As per the paragraph 6 of the SA, the appellant has agreed to withdraw the above-captioned appeal.

We have examined the terms of the SA. The same appear to be lawful. 6.

Accordingly, the prayer made in the application is allowed. 7.

The parties, who are represented by their respective counsel, undertake to abide by the terms of the SA.

We may note that the counsel and the parties have joined the proceedings through video conferencing.

The parties have been identified by their respective counsel.

Furthermore, the parties have confirmed to us that the settlement has been arrived on their own volition, without any coercion. MAT.APP.(F.C.) 277/2023 10.

In view of the order passed in CM APPL.39120/2024, nothing further remains to be done in the appeal.

Consequently, the date already fixed in the appeal i.e., 23.09.2024 shall stand cancelled.
