The grievance of the petitioner relates to the extension of stay granted by the Tribunal initially on 15.03.2017 in respect of the appeal pending before it for the assessment year 2012-13. We are informed that the appeal is now listed before the Tribunal on 17.09.2019.

Learned counsel for the respondent states that the grant of stay is subject to the condition that the assessee shall not take any undue adjournments.

Keeping in view the aforesaid, we dispose of this petition with a request to the Tribunal to take up the appeal itself for hearing on the next date fixed before it and neither party shall seek or be granted any adjournment.

The petition stands disposed of in the aforesaid terms. Dasti.
