Crl. M.C.No.551/2016 & Crl. M.A. No. 2310/2016 (Exemption from personal appearance), Crl. M.A. No. 2309/2016 (Stay) By this petition filed under Section 482 of Cr. P.C., the petitioner is seeking quashing of the order dated 19.08.2015 passed by the learned ACMM.
I have gone through the order passed by the learned ACMM. Perusal of the order reveals that the police sought the non-bailable warrants against the petitioner as the petitioner was absconding and in the application itself, the order of NBW were ordered to be served for 30th April 2016.
At this stage, learned Additional Public Prosecutor for the State has submitted that the State is to initiate proceedings under Section 82 of Cr. P.C. against the petitioner.
In the facts and circumstances of the present case, this Court is not inclined to accede to the prayer sought by the petitioner. Accordingly the petition as well as applications filed by the petitioner are dismissed in limine.
The petition as well as applications filed by the petitioner are disposed of as such.
