% 15.09.2020 This matter is being heard through video-conferencing. I.A. 7636/2020 1.

This is an application filed by the petitioner with the following prayers:

"In view of the facts stated and submissions made herein above, it is respectfully prayed that this Hon'ble Court may be pleased to:

(a) Allow the present Applicant to withdraw OMP (Comm) No. 379 of 2019 and all, interlocutory applications filed thereunder namely IA No. 12707 of 2019, IA No. 12709 of 2019 and IA No. 12710 of 2019;

(b) Direct the Respondent to release and handover the Bank

Guarantee No.003GM07100270001 amounting to Rs.1,09,50,000/- (Rupees One Crore Nine Lakh Fifty Thousand Only) to the Petitioner in compliance with Clause 3(iv) of the Settlement Agreement dated 17.08.2020.

(c) pass any other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case."

Mr. Karan Mehta, learned counsel appearing for the petitioner states that in view of the fact that the parties herein have settled their inter se disputes by entering into a settlement agreement dated August 17, 2020, the petitioner intends to withdraw the petition being OMP (COMM) 379/2019. 3.

Mr. Ankur Gupta, learned counsel appearing for the respondent acknowledges the submission made by Mr. Mehta. 4.

Mr. Mehta and Mr. Gupta state that the parties shall adhere to the terms of the agreement. Taking their statement on record, the petition being OMP (COMM) 379/2019 and connected applications are dismissed as withdrawn.

The application is disposed of.
