O R D E R
% 07.02.2017 Ms. Kapoor has tendered in Court a status report, which is taken on record. The fact regarding the Sagai ceremony of the petitioner's son to be held on 10.02.2017 and the marriage to be held on 22.03.2017 has been got verified.
The nominal roll on record shows that the petitioner is undergoing a life sentence on four different counts, and he has undergone 22 years and 28 days as on 05.01.2017. The petitioner has been released on parole on 9 earlier occasions. The last parole was availed of by him between 19.01.2017 and 02.02.2017.
Considering the fact that the petitioner's jail conduct is reported to be satisfactory and there is no report of his having abused the earlier liberty
granted to him and the fact that the Sagai and the marriage of the petitioner's son has now been fixed, the petitioner is directed to be released on parole for a period of four weeks in two spells of two weeks each, subject to: vii) The petitioner shall firstly be released on parole upon his furnishing before 10.02.2017 his personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent; viii) he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;
ix) he shall report at the local police station to mark his attendance on every Monday at 11:00 a.m. during the period of parole; x) he shall duly surrender at the end of the period of each spell of parole; xi) he shall also not indulge in any criminal activity while on parole; and xii) the second spell of parole for a period of two weeks shall be availed of by the petitioner between 10.03.2017 and 25.03.2017 provided the petitioner complies with the aforesaid terms & conditions of the parole.
The order be communicated to the Jail Superintendent as well as to the concerned Trial Court today itself.
