The Petitioner has approached this Court for setting aside the Order dated 03.02.2021 passed by Respondent No.1 impounding the passport of the Petitioner.

It is stated that the passport of the Petitioner had been impounded under Section 10(3)(b) of the Passports Act, 1967 on the ground that the Petitioner was an accused in FIR No.676/2007 dated 05.09.2007 registered at Police Station Paschim Vihar for the offences under Sections 452/427/323/34 IPC.

It is stated that undisputedly as of now there is no criminal case pending against the Petitioner.

In view of the above, the Impugned Order dated 03.02.2021 is set aside. The Respondent No.1 is directed to release the passport of the Petitioner.
