A Petition under Section 482 Cr.P.C. has been filed on behalf of the Petitioner for quashing Order dated 06.10.2017 in Complaint Case No.12705/2016 under Section 138 NI Act and proceedings emanating there from on the ground that according to the Accused the Cheque amount have already been paid. However, the counsel for the Petitioner has referred to the cross-examination of the Complainant in support of his assertion. 2.

The record revealed and it is also submitted on behalf of the Respoddent/Complainant that the evidence has been led and has been held up at the stage of evidence of the Accused purely on account of an interim stay granted in the present matter.

Since, the evidence is being recorded and the quashing is sought on the ground of admissions of the Complainant in the cross-examination, the Petitioner is at liberty to agitate the same before the learned Trial Court. 5.
