CRL.M.C. 529/2017 This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioner for quashing of orders dated 27.02.2015 whereby non-bailable warrants were issued against the petitioner and order dated 25.06.2015 whereby the petitioner has been declared as a proclaimed offender (P.O.) in

case FIR No.277/2014, under Sections 448/420/468/471/120-B IPC, P.S. Burari, Delhi.

Learned counsel for the petitioner submits that factually the petitioner has purchased the plot in question from the rightful owner and the allegations as alleged in the FIR against the petitioner are false and baseless, however, the Court below proceeded with issuance of process under Sections 82/83 Cr.P.C. Counsel further submits that the petitioner is ready to join the investigation and for this purpose the petitioner may be given protection to enable him to join investigation within one week. At this stage, counsel for the petitioner submits that the petitioner will join the investigation on 16.02.2017.

Considering the facts and circumstances, the petitioner is directed to join the investigation within one week and he shall move an appropriate application before the concerned Court below which shall be heard and disposed of by the Trial Court in accordance with law. In the meanwhile, in the event of his arrest, the petitioner shall be released on bail, on his furnishing a bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the Investigating Officer/SHO concerned till 16th February, 2017.

With these directions, the present petition is disposed of. Copy of this order be given dasti to the parties, as prayed. I.S.MEHTA, J FEBRUARY 08, 2017 'dc'
