30.03.2024, passed by the learned ASJ - 06, South Saket Court, New Delhi, in Criminal Appeal No.70/2020, reversing the Order dated 06.02.2020, passed by the learned ACMM dismissing the application filed by the Respondent No.2 herein under Section 340 Cr.P.C read with Section 195(1)(b) Cr.P.C.

It is contended by the learned Counsel for the Petitioners that the learned ASJ has virtually convicted the Petitioners and it will have an effect on the trial.

When this Court suggested the learned Counsel for the Petitioner that the learned ACMM would be directed to proceed further with the matter without being influenced by the observations made by the learned ASJ, learned Counsel for the Petitioner seeks permission to withdraw the present Revision Petitions.

Learned ACMM is directed to proceed with the matter in accordance with law uninfluenced by the findings of the learned ASJ for the reason that the findings of the learned ASJ should be limited only for the purposes for which the learned ASJ was hearing the matter. 5.

It is also made clear that all the rights and contentions of the parties are left open and are to be decided by the learned ACMM in accordance with law.

The Petitions are disposed of as withdrawn along with the pending applications, if any.
