The instant petition under Article 115 of the Constitution of India read with Section 151 of the Code of Civil Procedure, 1908 has been filed on behalf of petitioner seeking following reliefs: "(a) Set aside the orders dated 03rd June, 2024 passed by Sh. Sanjay Jindal, Ld. District Judge, Commercial Court, West District, Tis Hazari Courts, in Ex. Petition (Commercial) No. 71 of 2024;

(b) Stay the execution petition and the proceedings there of thereto till the present revision petition is disposed off and moreover till the curative petition filed by way of diary no. 17405/2024 is listed and considered by the Hon'ble Supreme Court;

(c) Pass any other order or orders or writ or direction that this Hon'ble Court may deem fit and proper in the circumstances of the case.

After some length of arguments, learned senior counsel appearing on behalf of the petitioner, on instructions, seeks leave to withdraw the petition with liberty to file an appropriate application before the Court concern. 3.

It is also submitted by the learned senior counsel for the petitioner that since the matter is listed for appointment of Bailiff, the Trial Court may be directed to defer the date of appointment of Bailiff till the decision on the objection regarding the pecuniary jurisdiction of the Court concerned. 4.

The instant revision petition is accordingly dismissed as withdrawn along with pending applications with liberty to file an appropriate application before the Court concerned within one week. 7.
