% 07.02.2018 After some hearing, the learned counsel for the petitioner submits that the petitioners - who had instituted the eviction case on the ground of bona fide need against the second respondent herein in the Court of Rent Controller, South East District wherein the application under Order 1 Rule 10 and Section 151 of the Code of Civil Procedure, 1908 (CPC) was filed by the first respondent which was dismissed by the Rent Controller by order dated 28.11.2017 and which order is now subject matter of appeal (RCT/ ARCT No. 26/17) before the Rent Control Tribunal, South East District leading to the interim order dated 02.02.2018 being passed which was sought to be impugned in the present petition - now concede that the prayer of the first respondent Rajeev Tandon for impleadment as a respondent may be allowed. The counsel submitted that submissions to this effect would be CM(M) 152/2018
made before the Rent Controller by the petitioners and after prayer has been granted, these developments would be brought to the notice of the Rent Control Tribunal so that the pending appeal wherein the impugned order was passed may be appropriately disposed of.
With above submissions, the counsel for the petitioner submits that the present petition is not pressed. It is disposed of accordingly. Dasti under the signatures of Court Master.
