The learned counsel appearing on behalf of the respondent nos. 4 and 5 submits that the vehicle in question has been released by respondent nos. 4 and 5 after the petitioner paid all the defaulted instalments. 2.

The learned counsel appearing on behalf of the petitioner fairly states that the vehicle which was seized by the respondent nos. 4 and 5 has been returned. However, he submits that the only surviving controversy is with regard to the claim of compensation/damages.

Faced with the above situation, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to file a civil suit to claim compensation/damages from the respondents.
