The petitioner has approached this Court being aggrieved by the respondents failure to decide his representation dated 08.06.2024 wherein he has prayed for release of financial benefits under the NPS scheme. It may be noted that the petitioner has been dismissed from service and the said dismissal is a subject matter of challenge before this Court by way of W.P.(C) No.8233/2024.

Learned counsel for the petitioner submits that the petitioner has been compelled to approach this Court as despite his detailed representation made on 08.06.2024, the respondents have neither released the amount which he claims is payable to him despite his dismissal from the service, nor informed of any reason for not releasing his dues.

Learned counsel for the respondents accepts notice and assures this Court that the petitioner's representation will be decided within the time as may be directed by this Court.

In the light of the aforesaid stand taken by the respondents, the writ petition is disposed of by granting the respondents four weeks time to decide the petitioner's representation dated 08.06.2024 by passing a reasoned and speaking order. Copy of the said order will be communicated to the petitioner as also to his learned counsel.

It is, however, made clear that in case, the petitioner is aggrieved by any order passed by the respondents, it will be open for the petitioner to seek legal recourse as permissible in law.
