The present petition under Section 482 of the Cr.P.C. read with Section 96 of the Insolvency and Bankruptcy Code, 2016 seeks the following prayers: <(a) Allow the present Petition;

(b) Pass an Order for Discontinuance/ Quashing/ Stay of the proceedings being Complaint Case bearing CC No. 8374 of 2019 initiated under Section 138 of the Negotiable Instrument Act, 1881 in terms of Moratorium in force under Section 96 Insolvency & Bankruptcy Code, 2016 read with the law laid down by the Hon9ble Punjab & Haryana High Court in the matter of in <Vijay Kumar Ghai v. Pritpal Singh Babbar= in CRM-M-22685-2021; (c) Consequently, pass an Order thereby, to Quash/ Stay summons issued vide order dated 02.07.2019 passed by the Ld. Metropolitan Magistrate, Patiala House Court, New Delhi upon the Petitioner and all the subsequent proceedings carried by the Ld.
