This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :- "[a] Issue a suitable writ for quashing the ultra vires withdrawal order dated 19.12.2019 passed by the Respondent No.2 vide which the recognition of the Petitioner for B.Ed. Course has been withdrawn; and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. [b] Issue a writ of mandamus and direct the Respondent No.2 to issue restoration order in favour of the Petitioner for B.Ed course expeditiously and in a time bound manner; and..." 2.

Mr. Sethi, learned counsel for the respondents at the outset submits that against the impugned order withdrawing recognition, the remedy of appeal is available under Section 18 of the NCTE Act, 1993, therefore, the present petition is not maintainable on account of an alternative efficacious statutory remedy being available. 3.

Faced with this situation, Mr. Kumar, learned counsel for the petitioner seeks to withdraw the present petition with liberty to prefer an appeal before the learned Appellate Authority in terms of the statutory provisions.

Accordingly, the petition is dismissed as withdrawn with the aforesaid liberty.

Needless to add that the petitioner college shall be at liberty to avail the remedies available to it in the event the learned Appellate Authority decides against the petitioner.
