The present petition impugns a Show Cause Notice dated 21.05.2025.

Learned counsel for the Petitioners limits his submissions to the suspension of concessionaire from participating in ongoing/ future projects for a period of one month.

Learned counsel for the Petitioners relies upon the Order of this Court dated 27.05.2025 passed in W.P.(C) 7494/2025 titled as M/s Highway Engineering Consultant Vs. National Highways Authority of India to contend that in a matter pertaining to the independent Engineer of the same project of which the Petitioners herein is the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. concessionaire, this Court was pleased to pass the following Order: "7. After some hearing, with the consent of the learned counsel for the respondent, it is directed that since the petitioner has already responded to the said SCN dated 22.05.2025, paragraph 4 thereof shall be kept in abeyance, subject to the right of the respondent to pass a reasoned order suspending business dealings with the petitioner, if so warranted in the facts and circumstances of the case and considering the reply already submitted by the petitioner. Further, the respondent shall grant an opportunity of hearing to the petitioner within a period of 3 days from today, prior to passing the said order. The same shall be subject to the final adjudication of the SCN dated 22.05.2025.

8. Learned counsel for the petitioner assures and undertakes that no adjournment/deferment of the hearing/s that may be scheduled, shall be sought by the petitioner under any circumstance. The said statement is taken on record."

Learned counsel for the Respondent states that in the present case, the Petitioners would also be accorded the opportunity of physical hearing tomorrow to which the learned counsel for the Petitioner states that he will ensure that his representation is filed by 10:30 in the morning.

Accordingly, the Petitioners are directed to file representation by 10:30 A.M. tomorrow.

The Respondent is directed to take a decision after granting physical hearing to the Petitioner by 05:30 P.M. on 04.06.2025. The copy of such Order be communicated to the Petitioner expeditiously. 7.

The present petition, along with the pending application, is disposed of in the above terms.

Needless to state that this order does not preclude the legal remedies available to the Petitioners against any such order passed by the Respondent.
