O R D E R

The petitioner seeks quashing of FIR No. 797 of 2015 under Sections 392/394/411 of the IPC Police Station Keshav Puram, Delhi, based on a settlement.

The allegations against the petitioner are that the petitioner who is today aged 22 years of age, under influence of alcohol snatched the mobile phone of the complainant/respondent no. 2.

Respondent no. 2 is present in court in person and is identified by the Investigating Officer. He submits that he has settled his dispute with the petitioner and is agreeable to the settlement and does not wish to press the criminal charges against the petitioner any further. 4.

The petitioner who is present in person in Court shows remorse and CRL.M.C. 668/2018

regret at his conduct. Respondent no. 2 submits that he has accepted the regret shown by the petitioner. Petitioner further volunteers that he shall be rendering community services in Gurudwara Keshav Puram for one hour a day for one week to show that he regrets his conduct. 5.

In view of the fact that the disputes between the petitioner and respondent no. 2 have been settled and the fact that petitioner has volunteered to render community service at Gurudwara Keshav Puram for one hour a day for the next one week, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from.

In view of the above, the petition is allowed. FIR No. 797 of 2015 under Sections 392/394/411 of the IPC Police Station Keshav Puram, Delhi and the consequent proceedings there from are, accordingly quashed. The petitioner, as volunteered by him, shall render community service at Gurudwara Keshav Puram for one hour a day for the next one week. 7.
