A Petition under Section 482 Cr.P.C has been filed on behalf of the petitioner, wherein it is submitted that the petition under Section 156(3) Cr.P.C has been filed by the complainant but a long date of five months has been given which is highly prejudicial to the interest of the petitioner. A request is made that the directions be issued to the concerned ACMM to prepone the date of hearing from 05.11.2024 preferably to July, 2024 and also give directions to the learned ACMM to call for the Action Taken The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The learned Prosecutor has submitted that an earlier complaint was filed on the similar allegation before EoW, who under preliminary enquiry did not find any congnizable office to have been committed and thus, has closed the said complaint.
Now because no FIR has been registered, the petitioner has approached the Court in a Complaint under Section 200 read with Section 156(3) Cr.P.C in which the Action Taken Report is being prepared by the I.O.

On the instructions from the I.O, who is present in the Court, it is submitted by the learned Prosecutor that the Status Report shall be filed within one week before the learned ACMM.

On the filing of the Status Report, the learned ACMM shall consider the same and prepone the date within one week. The matter be taken up by the learned ACMM on 01.08.2024 to consider the Status Report and to proceed in the matter expeditiously.

The petition is accordingly disposed of.
