This petition is filed for setting aside impugned order dated 4th January 2024, passed by the Principal Judge, Family Courts, Central District, Tis Hazari, Delhi in MT No.70/2021 whereby the Court ordered the petitioner to pay Rs.4,000/- per month, totalling to Rs.12,000/- per month to respondent wife and two minor children, from the date of filing till final disposal of the interim maintenance application.

It was noted in the impugned order that there was a plea made by wife's counsel that she was at the verge of starvation and looking after two minor children aged about 9 and 7 years. Accordingly, interim maintenance of Rs. 4,000/- each per month to wife and children has been granted. Matter has now been put up for further proceedings by the Court. 3.

The Court has also perused the petition which was filed under Section 125 Cr.P.C. and submissions of respondent-wife. two minor children being looked after by the wife, and the amount being reasonable, impugned order cannot be interfered with. 4.

Counsel for petitioner states that they are ready to settle the matter. This offer can be made before the Family Court and if both the parties are agreeable, the Family Court may refer them for mediation. 5.

The instant petition is therefore dismissed.
