The present petition has been moved challenging the order dated 02.08.2023 passed by the learned Trial court whereby the learned Trial Court has declined to frame an issue, which goes to the root cause of the case.

After making submissions, the learned counsel seeks permission to withdraw the present petition with liberty to file an appropriate application before the learned Trial Court seeking amendment of issues.
