This appeal is preferred against the judgment dated 31.05.2024 passed by the learned Single Judge in OMP (COMM) 104/2024. 3.

The impugned judgment rendered by the learned Single Judge arose out of an order dated 25.01.2024 rendered by the learned Arbitrator whereby, the appellant's application under Section 16 of 'The Arbitration and Conciliation Act, 1996' [in short, the "Arbitration Act"] was dismissed. After some arguments, learned counsel for the appellant seeks to withdraw the appeal with liberty to raise the contentions put forth in the appeal before the learned Arbitrator.
