% 05.11.2019 This is a petition filed under Section 11 (6) of the Arbitration and Conciliation Act, 1996 for appointment of an arbitrator. The relevant clause with regard to the arbitration is clause 19 of the agreement (page 7), which reads as under:
"19. All disputes or differences whatsoever arising between the parties out of this agreement shall be settled by Arbitration in accordance with Arbitration and Conciliation Act of 1996 and the venue shall be New Delhi."
The petitioner has issued a notice of invocation vide letter dated June 3, 2019 proposing the name of an Advocate to act as arbitrator. It appears that there was no response to the invocation letter and accordingly this petition has been filed.
Mr. Ashok Kr. Verma, learned counsel appearing for the respondent states, he has no objection, if an arbitrator is appointed for adjudicating the
inter se disputes between the parties.
Noting the said submission, this court appoints, Mr. H.K. Chaturvedi, Adv. (Mobile Nos. 9811035762, 9015582334, 9311525870) as an arbitrator, who shall adjudicate the inter-se disputes between the parties. The terms of the appointment of the arbitrator shall be regulated by the Arbitration and Conciliation Act.
The petition stands disposed of.
