% 27.05.2024 I.A. 30499/2024 By way of the present application filed under section 151 of the Code of Civil Procedure 1908 ('CPC') the petitioner/applicant seeks disposal of the present petition as having been rendered infructuous in view of the settlement between the parties based on an Offer of Settlement, stated to have been made by the respondent under the "Vivad se Vishwas-II (Contractual Dispute)" Scheme on 17.05.2024 on the Government eMarketplace (GeM) portal, which counsel states, was accepted by the petitioner on 21.05.2024.
Though there is some discordance in the submission made and what is narrated in para 2(j) and 2(k) of the present application, Mr. Amit Meharia, learned counsel appearing for the petitioner/applicant submits, that what is narrated in the said paras is erroneous, since the offer was made by the respondent and was accepted by the petitioner.
