% 13.02.2018 After some arguments, learned counsel for the petitioners submits that at this stage, he is confining his prayers to prayers (a) & (e) made in the writ petition. Vide order dated 12th February, 2018, learned counsel for the respondents was granted time to get instructions and today Mr.Kirtiman Singh, learned counsel appearing for the respondent fairly submits that the respondent no.1, while issuing the rank list proposed to be issued on 15th February, 2018, will declare the score list and the merit position of all the candidates and thus the prayer (a) of the petition would stand satisfied. As far as prayer (e) of the petitioner is concerned, he has sought a direction to respondent no.1 to consider the aggregate MBBS marks as furnished by the petitioner no.1 vide email dated 4th February, 2018 if needed, at the time of considering, the issue of tie breaking. It may
be noted that the requirement of considering the petitioner's marks in MBBS would arise, only in case an issue of 'tie' arises between candidates scoring equal marks in the NEET-PG Exam, 2018. Mr.Singh, further submits that, though the petitioners were required to submit their MBBS marks before 31st January, 2018 but keeping in view the fact that the date of declaration of the merit list has been postponed, the respondent no.1 would consider the marks obtained by the petitioner no.1 in MBBS despite the same having been submitted belatedly.
Since no other relief is being pressed by the petitioner at this stage, nothing further survives for adjudication, the writ petition and application are disposed of in the above terms. FEBRUARY 13, 2018/aa REKHA PALLI, J
