This is an application filed under Section 151 of the CPC, 1908, on behalf of the petitioner seeking withdrawal of the writ petition with liberty to file fresh petition on the same cause of action by incorporating all relevant facts and grounds.

For the reasons stated in the application, issue notice. 3.

Mr. Kapur, learned counsel accepts notice on behalf of the respondent Nos. 1 and 2 and has no objection to the application being allowed. 4.

There is nobody appearing on behalf of the respondent Nos. 3 and 4, however the application is being taken up for hearing. 5.

In view of no objections raised by the respondent bank, the application is allowed.
