+ CRL.M.C. 1093/2018 JEETU @ JEET SINGH & ORS ..... Petitioners Through:

Mr. Pankaj Kumar, Adv.

versus STATE (GOVT OF NCT) OF DELHI & ORS ..... Respondents Through:

Ms. Meenakshi Dahiya, APP with ASI Virender Kumar, P.S.Zafrabad.

Respondent nos. 2 and 3 are present in Court.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 14.05.2018 Notice could not be issued to the respondent nos. 2 and 3 as process fee was not filed. However, respondent nos. 2 and 3 have entered appearance and accept notice. They have been identified by ASI Virender Kumar of police station Zafrabad. They submit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion vide Compromise Deed dated 2nd February, 2018.

They further submit that they have no objection in case FIR No. 115/2014 under Sections 323/452/506/34 IPC registered at Zafrabad is quashed. Affidavits of respondent nos. 2 and 3 are also on record to this effect.

Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 and 3 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.
