The present Writ Petition (Crl.) under Article 226 of the Constitution of India read with Section 482 Cr.P.C has been filed seeking quashing of FIR No. 168/2024 registered at P.S. IGI Airport, New Delhi, for the offence punishable under Section 30 Arms Act, 1959.

The petitioner is presently posted as Entertainment Tax Inspector at District Gautam Budh Nagar (UP). The petitioner was having valid Arms License of One N.P.B Revolver/Pistol No. C-9553 of 32 bore and authorized to keep 10 cartridges as well. The license of the petitioner was valid up to 31.07.2026.

On 01.03.2024 the petitioner had to travel from Delhi to Guwahati by Air India Express Airlines Flight No. IX-783 from Terminal-3 IGI Airport. At the time of security check, the baggage revealed four cartridges of 32 bore were found in some small zipped chamber. Accordingly, an FIR was registered.

The petitioner states that since he is a valid license holder, therefore, there was no conscious possession of the said cartridges. 5.

Issue notice.

Notice is accepted by learned ASC for the State. 7.

Verification report has been handed up to the Court that endorses the factum of the arms license in favour of the petitioner. The same is also confirmed through the IO, who is present in Court. 8.

In these circumstances, no purpose would be achieved in keeping these proceedings pending. The FIR alongwith all proceedings emanating therefrom stands quashed.
