This is a petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of the Sole Arbitrator with respect to contract dated 19.04.2011. The arbitration clause is Article 9 of the Contract.

Since there were disputes between the parties, the petitioner invoked the arbitration clause vide legal notice dated 25.12.2023. 19.

respondent and states that he has no objection to the petition being allowed. However, he states that the arbitration may be governed by the rules of Scope Forum of Conciliation and Arbitration („SCFA‟). 21.

Ms Gupta, learned counsel for the petitioner has no objection to the same.

For the said reasons, the petition is allowed. Since the parties are still having disputes between them, the following directions are issued:- vii) JR Aryan (District Judge Retd.), (Mob. No. 9958697034) is appointed as a Sole Arbitrator to adjudicate the disputes between the parties.

viii) The arbitration will be held under the aegis of the Scope Forum of Conciliation and Arbitration („SCFA‟).

ix) The learned Arbitrator is requested to furnish a declaration in terms of Section 12 of the Arbitration & Conciliation Act, 1996 prior to entering into the reference.

x) It is made clear that all the rights and contentions of the parties, including as to the arbitrability of any of the claim, any other preliminary objection, as well as claims on merits of the dispute of either of the parties, are left open for adjudication by the learned arbitrator.

xi) The parties shall approach the learned Arbitrator within two weeks from today.

The petition is allowed and disposed of in the aforesaid terms.
