The applicant seeks to be released on bail in case FIR No. 13/2020 of PS Laxmi Nagar for offences under Sections 406/420/34 IPC. On merits, bail application of the applicant stands dismissed till Supreme Court. However, learned counsel for applicant presses this bail application largely on the ground under Section 436A CrPC. It is contended on behalf of applicant that the maximum punishment that can be awarded to him is imprisonment for seven years and out of that period, more than half have been covered. On this aspect, learned prosecutor has taken me through Explanation to Section 436A CrPC.
