As the petitioner is admittedly a national of the United States of America and habitually resident in the United States of America, Mr. Manish Vats, learned counsel for the petitioner, submits that the proposed arbitration constitutes an "International Commercial Arbitration" within the meaning of Section 2(1)(f) of the Arbitration and Conciliation Act, 1996. He, therefore, seeks permission to withdraw this petition, with liberty to approach the Supreme Court for the appointment of an arbitrator.
