Present petition has been filed for quashing of case FIR No.0052 dated 07.04.2023 registered under Section 67 (A) of Information Technology act, 2000 and Section 354 (D) IPC at PS Cyber Police Station, Dwarka and all the other proceedings emanating therefrom. 2.
The FIR was lodged on the statement of Respondent No.2 alleging therein that certain obscene messages were being repeatedly sent by the Petitioner since the year 2018. It was alleged in the FIR that the Petitioner had sent all the obscene and indecent messages at different times from different numbers to the Respondent No.2. No.2 in her FIR had alleged that since February, 2023 the petitioner repeatedly had sent obscene messages and videography through Whatsapp. The Respondent No.2 had further alleged that she was repeatedly being harassed and stalked by the Petitioner. 3.
However, now, the parties have settled the matter vide MOU/settlement deed dated 06.06.2024 on the following terms and conditions:
5. That the second Party has thus agreed to withdraw the complaint made against the First Party and the second party shall make statement before the concerned Hon'ble court or police authorities in this respect of said FIR, as and when required.
6. All the disputes between the parties stands finally resolved and there is no ill will or complaint against each other in any manner. The parties have thus decided to file petition for quashing of FIR on the basis of compromise deed.
7. That FIR quashing settlement deed has been executed between the parties with their mutual consent and free will without any force, pressure,coercion or undue influence from any side.
8. That any complaint by the second party against first party shall standwithdrawn, cancelled and revoked finally after signing of this mutual compromise deed.
9. That present Quashing compromise deed is irrevocable and violation of any of the terms of compromise deed shall be deemed to be violation of the Compromise Deed."

The complainant/respondent no.2 states that she has settled the matter with her own free will without any fear, force or coercion. IO has identified the parties.

In view of the settlement, the FIR No.0052 dated 07.04.2023 registered under Section 67 (A) of Information Technology Act, 2000 and Section 354 (D) IPC at PS Cyber Police Station, Dwarka and all the other proceedings emanating therefrom are quashed.
