By way of the present Criminal Miscellaneous Petition under Section 528 of BNSS, 2023, the petitioner seeks to challenge the impugned orders dated 22.03.2025 and 07.05.2025 passed by the Court of learned JMFC in CR CASE No. 85903/2016 captioned State vs. Rajan Bajaj etc. and all the consequential proceedings arising therefrom.

After some arguments, learned APP for the State submits that he would have no objection, in case this Court were to quash the impugned The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. orders but direct the petitioners to make themselves available for the purpose of hearing on charge. He also submits that since the matter has been pending from the year 2016, there should be no delay in framing of charges. 5.

In view of the aforesaid, Mr. Maninder Singh, learned Senior counsel appearing for the petitioners submits that he too has no objection in case such an order is passed containing such directions. 6.

In view of the above, the impugned orders dated 22.03.2025 and 07.05.2025 in CR CASE No. 85903/2016 are hereby quashed and set aside. 7.

It is made clear that the learned JMFC-04 (South East) District, Saket Court shall take up the matter for hearing arguments on framing of charges on 07.07.2025 instead of 21.07.2025.

Since this Court has been informed that the petitioner no.2-Mr. Ritik Bajaj is employed in Dubai and, therefore, it may not be possible for him to appear physically on 07.07.2025, thus as an exception, the petitioner no.2Mr. Ritik Bajaj is permitted to appear through Video Conferencing only on 07.07.2025. No objection on the appearance of Mr. Ritik Bajaj shall be taken by the prosecution or the complainant for 07.07.2025. 9.

The learned JMFC is at liberty thereafter to summon the petitioner no.2 on any subsequent date, according to the requirements of the stage of proceedings.

In that view of the matter, the present application is disposed of in the aforesaid terms.
