O R D E R

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 ('CrPC') seeking quashing of FIR No. 268/2024 dated 10.05.2024, for offences punishable under Sections 323/341 of the Indian Penal Code, 1860 ('IPC'), registered at Police Station Fatehpur Beri, including all consequential proceedings arising therefrom. The FIR was registered on a complaint filed by Respondent No. 2. 2.

The learned counsel for the petitioner submits that the parties had known each other and a quarrel took place due to a trivial issue. The parties have since resolved all the disputes and the complainant does not wish to pursue any proceedings arising out of the present FIR.

He submits that the parties are also neighbours and want to live their future lives peacefully.

The petitioner is present in person and states that he has already tendered unconditional apology and has undertaken not to indulge into any such activity in future.

The present petition is filed on the ground that the matter is amicably settled between the parties by way of a Memorandum of Understanding cum Settlement dated 19.05.2024, on their own free will, without any undue pressure, force, coercion or undue influence.

The parties are present before this Court in person and have been duly identified by the Investigating Officer. 7.

The complainant, who is present in the Court, states that he has since forgiven the accused since he has tendered unconditional apology and being neighbours, he wishes to live peacefully in future. He states that he does not wish to pursue the proceedings arising out of the present FIR, and has no objection if the proceedings are quashed.

The investigation is at a nascent stage.

Offences under Sections 323/341 of the IPC are compoundable in nature.

This Court is of the opinion that no useful purpose would be served by relegating the parties to the learned Trial Court for filing an application to compound the offence. 11.

In view of the above, FIR No. 268/2024 and all consequential proceedings arising therefrom are quashed. 12.
