The present application has been filed seeking stay of further proceedings in C.S. DJ No. 883/2021.

The matter was passed over to enable learned counsel for respondent Nos. 1 and 2/plaintiffs to appear. The Court Master has also contacted learned counsel for respondent Nos. 1 and 2 and was assured that appearance will be entered in the post-lunch session. However, none appears for respondent Nos. 1 and 2.

The present civil revision petition is directed against an order of the Trial Court dated 01.12.2023, by which an application filed by the petitioner (defendant No. 3 in the suit) under Order VII Rule 11 of the Code of Civil Procedure, 1908 ["CPC"] has been dismissed. 4.

to take appropriate steps before the Trial Court. She submits that the withdrawal of the revision petition is without prejudice to the petitioner's rights and contentions before the Trial Court, including the right to raise all available defences, to apply under Order I Rule 10 CPC for deletion of the petitioner from the array of parties, and to seek an order of costs against the plaintiffs.

In view of the aforesaid submission, the revision petition, along with the pending applications, is dismissed as withdrawn, without prejudice to any rights and remedies that may be available to the petitioner in law. It is made clear that this Court has not examined or expressed any opinion on the merits of such rights and remedies. 6.

The next date of hearing already fixed, i.e., 28.11.2025, stands cancelled.
