CM APPL.9875/2025 (filed on behalf of the petitioner for directions) 1.

This is an application filed by the petitioner seeking early hearing. 2.

Considering the averments made in the application, the same is allowed ; W.P.(C) 12531/2023 is taken up for hearing today itself. W.P.(C) 12531/2023 3.

The present writ petition has been filed by the petitioner being aggrieved by the failure on the part of the respondent no.2 to settle the petitioner's insurance claim for Rs.4,70,257/- . 4.

Learned counsel for the petitioner submits that the factual matrix of the present case is identical to W.P.(C) 12554/2023 and the petitioner The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is pointed out that the W.P.(C) 12554/2023 was disposed of by order dated 10.02.2025, which inter-alia, directs as under : "5. At the outset, the petitioner draws attention to the order dated 16.12.2024 which records that the petitioner is confining itself to seeking that the respondents be directed to examine the claims and take a decision thereon, which has not so far been done on account of lack of documentation.

6. Learned counsel for the petitioner further submits that the petitioner has provided the requisite document/s to the respondent/s and if any further document is required, the same shall also be duly provided.

7. Learned counsel for the respondent no.2 (New India Assurance Co. Ltd.) submits that respondent no.2 shall examine the claim/s of the petitioner in the light of the documents submitted by the petitioner. He further submits that if any other document is required by the petitioner, the same shall be duly sought. The said statement is taken on record.

8. Let the requisite decision be taken by the respondent no.2 expeditiously and preferably within a period of three months from today.

9. In view of the aforesaid, learned counsel for the petitioner does not wish to press the present petition; the same is consequently disposed of.

10. Needless to say, in the case the petitioner is aggrieved by the outcome of the aforesaid exercise, it shall be at liberty to avail appropriate remedies under law."

It is sought that the present petition be also disposed of in identical terms. Learned counsel for the respondents does not oppose the same. He submits that the respondent no.2 shall examine the claims of the petitioner in the light of the documents submitted by the petitioner. He further submits that if any other document is required by the petitioner, the same shall be duly sought. The said statement is taken on record. 6.
