The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act') inter alia, praying that an arbitrator be appointed for adjudication of the subject disputes.

At the outset, the learned counsel appearing for the respondent states that the respondent - Continental Engineering Corporation - is not an Indian company. He states that the aforesaid company is constituted under the laws of Taiwan and its principal office is located at No. 95, Dun Hua South Road, Section-2 Taipei-106, Taiwan City, Taiwan.

In view of the above statement, the learned counsel appearing for the petitioner seeks to withdraw the present petition with liberty to approach the Supreme Court.

The petition is dismissed as withdrawn.
