The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.874/2014 registered under Sections 376(2) IPC and Section 6 POCSO Act at PS Shalimar Bagh. Status report not filed. 2.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 28.08.2014. Statements of the prosecutrix 'X' (assumed name) and her sister 'Y' (assumed name) have been recorded before the Trial Court. 'X' in her deposition as PW-5 recorded on 07.09.2015 did not implicate the petitioner for the crime. Similarly, PW-4 - victim 'Y' in her statement recorded on 07.09.2015 has exonerated the petitioner. BAIL APPLN. 303/2016

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the Trial Court.
