Petitioner seeks modification of bail condition dated 05.05.2025. 2.

Petitioner was admitted to bail by the learned Trial Court vide order dated 05.05.2025 and while directing his release, in view of the facts and circumstances of the case and also considering his health condition, he was directed to be released on bail on his furnishing personal bond and two surety bonds in the sum of Rs. 50,000/- each. There were several conditions imposed upon him and one such condition was to the effect that he would provide his permanent address and mobile number to the investigating officer. 3.

application before the learned Trial Court seeking modification of the aforesaid bail condition but the learned Trial Court has rejected the aforesaid application.

This has given rise to the present petition.

During course of arguments, learned counsel for petitioner divulged that his one surety, who is jail official and his friend too, has been able to arrange one tenanted premises for him, situated at Jahangir Puri. 6.

After hearing arguments for some time, learned counsel for petitioner seeks to withdraw the present petition with liberty to file the application afresh before the learned Trial Court seeking modification of the bail order in terms of the aforesaid subsequent development. 7.

In view of the above, present writ petition is accordingly disposed of as not pressed. Liberty, as prayed, is granted. 8.

If any such application is moved, learned Trial Court shall consider the same on top-priority basis. However, it will be up to the learned Trial Court to get the aforesaid aspect of acquisition of such new tenanted premises duly verified through investigating agency.

A copy of this order be given dasti under the signatures of the Court Master.
