Though the present matter is listed today for consideration of CRL.M.A. 29158/2023, however with the consent of the parties, the present petition itself has been taken up for hearing. 2.

The petitioner has approached this Court by way of present petition seeking quashing of the order dated 14.09.2023 passed by learned Sessions Judge whereby it declined to interfere with the NBWs and proceedings under Section 82 Cr.P.C initiated against the present petitioner. 3.

From the records, it appears that on account of non-appearance, NBWs were issued against the present petitioner. The petitioner preferred an application seeking cancellation of the same. Magistrate dismissed the said application prompting the petitioner to file the instant petition.

Learned counsel for the petitioner states that the petitioner's nonappearance before the Court was unintentional and he undertakes to appear before the concerned Trial Court. The undertaking is accepted and taken on record. Considering the said statement, subject to petitioner's appearing in accordance with law before the Trial Court, the NBWs and the proceedings initiated under Section 82 Cr.P.C, which have been stayed by this Court on 22.09.2023 and the further fact that the petitioner has deposited Rs.20 lacs in terms of the order dated 22.09.2023 passed by this Court, the petition is allowed and the impugned order is set aside. The NBWs and proceedings initiated under Section 82 Cr.PC against the petitioner are quashed. 5.

The petition is disposed of in above terms along with pending application.
